Anti-Spam Policy

BulkSMSHub operates a zero-tolerance policy against spam. Every message sent through our platform must comply with applicable laws and have proper recipient consent.

⚠️ Zero Tolerance: BulkSMSHub takes a zero-tolerance approach to spam. Customers found sending unsolicited messages will have their accounts immediately suspended and may face legal action and financial penalties in applicable jurisdictions.

1. What Is Spam?

For the purposes of this policy, "spam" means any unsolicited commercial electronic message sent without the recipient's prior explicit or implied consent. This includes unsolicited SMS messages, WhatsApp messages, emails and other electronic communications sent in bulk.

Spam causes significant harm: it damages consumer trust, overloads carrier networks, results in your messages being blacklisted, and exposes senders to substantial fines (up to $10M under CASL, $43,792 per violation under CAN-SPAM, and $1,500 per violation under TCPA).

2. Mandatory Consent Requirements

All messages sent through BulkSMSHub must be to recipients who have given verifiable consent. We accept the following forms of consent:

Express (Explicit) Consent

  • Online opt-in form where the person checks a clearly labeled checkbox specifically for SMS/email marketing
  • SMS keyword opt-in (e.g., texting "JOIN" to a short code)
  • Written consent (paper or electronic signature)
  • Verbal consent recorded with timestamp and agent ID

Express consent is required for marketing/promotional messages in all jurisdictions.

Implied Consent

  • Existing business relationship within the past 24 months (CASL)
  • Publicly listed contact information for business-to-business communications

Implied consent is limited in scope and duration. It does not apply in all countries and cannot be used for promotional marketing in most jurisdictions.

3. Prohibited Practices

The following practices are strictly prohibited on BulkSMSHub:

  • Sending messages to purchased, rented, scraped or harvested contact lists
  • Sending to contacts who have previously opted out or unsubscribed
  • Falsifying, forging or misrepresenting sender information
  • Using deceptive subject lines, sender names or message content
  • Omitting required opt-out mechanisms
  • Sending outside permitted time windows (e.g., 8AM-9PM local time in the USA)
  • Sending to recipients on Do-Not-Call / Do-Not-Disturb registries
  • Sending prohibited content categories (SHAFT, adult, hate speech, illegal services)
  • Attempting to circumvent carrier filtering or anti-spam systems

4. Global Compliance Standards

BulkSMSHub customers must comply with all applicable laws in the jurisdictions where messages are sent and received. Key regulations include:

TCPA (USA)

Written prior express consent required for marketing SMS. Quiet hours 8AM-9PM recipient local time. STOP handling mandatory within 10 days.

🇨🇦

CASL (Canada)

Express or implied consent required. Opt-out must be honoured within 10 business days. Penalties up to CAD $10M.

🇪🇺

GDPR (EU/UK)

Consent must be freely given, specific, informed and unambiguous. Withdrawal of consent must be as easy as giving it.

🇮🇳

TRAI/DLT (India)

All commercial SMS must be DLT-registered with approved templates. Promotional SMS prohibited during opt-out hours.

🇦🇪

TDRA (UAE)

Licensed sender IDs required. DND registry filtering mandatory. Prohibited content categories enforced.

🇦🇺

ACMA (Australia)

Spam Act 2003: consent required, functional unsubscribe mechanism mandatory, accurate sender identification required.

5. Opt-Out Requirements

Every marketing message sent through BulkSMSHub must include a clear and functional opt-out mechanism:

  • SMS: Include "Reply STOP to unsubscribe" or equivalent. STOP replies must be processed within 10 business days (USA/Canada) or immediately (most other markets). BulkSMSHub's platform processes STOP replies automatically.
  • Email: Include an unsubscribe link in every marketing email. Unsubscribe requests must be processed within 10 business days.
  • WhatsApp: Customers must provide a mechanism for recipients to opt out of future WhatsApp marketing messages.

Once a recipient opts out, they must not receive further marketing messages from that sender. BulkSMSHub maintains opt-out lists and automatically suppresses opted-out numbers from future sends.

6. How We Enforce This Policy

BulkSMSHub uses the following mechanisms to detect and prevent spam:

  • Account Review: All new accounts undergo verification before full sending access is granted.
  • Content Filtering: Automated content scanning to detect prohibited content categories and spam patterns.
  • Delivery Rate Monitoring: High bounce rates, complaint rates or opt-out rates trigger automatic review and potential suspension.
  • Carrier Feedback: We receive spam complaint data from major carriers and use this to identify and act on abusive senders.
  • DNC Filtering: Automatic filtering against Do-Not-Call and Do-Not-Disturb registries where applicable.
  • Human Review: Our compliance team manually reviews flagged accounts and campaigns.

7. Consequences of Violations

Violations of this Anti-Spam Policy will result in:

  • First violation (minor): Warning and mandatory compliance training
  • Second violation or serious first violation: Account suspension pending investigation
  • Deliberate or repeated violations: Permanent account termination without refund
  • Severe violations: Referral to relevant regulatory authorities and potential civil legal action

8. Reporting Spam

If you have received an unsolicited message from a sender using BulkSMSHub infrastructure, please report it to us at abuse@bulksmshub.com. Include the message content, sender ID, timestamp and your phone number. We investigate all reports within 24 hours.
